General Promotion and Competition Terms and Conditions

IMPORTANT: Please read these terms and conditions carefully. They form a legally binding agreement between you and us. If you do not agree with these terms and conditions, please do not participate in any promotions or enter any competitions stated.

 

Promotional Codes & Discounted Pricing

The promoter reserves the right to extend, amend or withdraw the promotion or any part of it without prior notice or compensation, where this is due to circumstances beyond its control.

We reserve the right to amend or update these terms and conditions. Where we do this, we shall advertise any such amendments on our website

Discount code promotions are not exchangeable for cash and are non-transferable. Returned items will be refunded at the discounted price paid. This does not affect your statutory rights.

To redeem a promotional code, the offer code must be entered into the Promotional Code field on the shopping basket page and applied for the offer to be added to the order.

Promotional Codes and/or Discounted Pricing cannot be combined and only one offer can be applied to any order.

Promotional Codes and/or Discounted Pricing cannot be applied to our recurrring subscription service.

The Promotional Code and/or Discounted Pricing will expire on the date specified in the specific terms for the promotion (listed below), or before subject to availability. You cannot use the Promotional Code after this date.

General Competition Terms and Conditions

These terms and conditions apply to promotions featured in any publications and online services that are organised by Fabricsmart Ltd t/a Scrummi and the Fabricsmart Ltd t/a Scrummi and the UK Spa Association (or in connection to a third party on Fabricsmart Ltd t/a Scrummi and the UK Spa Association  behalf) and prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials.

 

  1. By entering the competition entrants accept these terms and conditions together with any specific instructions and terms for such competition which may be mentioned in any electronic messages, or on the website, or communicated to entrants in any other way (“competition information”). Such competition information shall prevail in the event of there being any inconsistency between these competition terms and conditions and any competition information. Please retain a copy for your information.

Competition Entry

  1. The competition is open to all residents of the United Kingdom, i.e. England, Northern Ireland, Scotland, and Wales. For the avoidance of doubt, Jersey, Guernsey, and the Isle of Man are not part of the United Kingdom for these purposes. Fabricsmart Ltd t/a Scrummi and the UK Spa Association may ask competition winners for proof of UK residency and if a competition winner is unable to prove their residency to Fabricsmart Ltd t/a Scrummi and the UK Spa Association ’s satisfaction (i.e. prove that they are physically present in the UK for 183 days or more in the previous or current UK tax year), Fabricsmart Ltd t/a Scrummi and the UK Spa Association reserves the right to select an alternative winner after 72 hours if the winner has not responded. All entrants must be of the age of 18 or over.

 

  1. Employees and members of their immediate families (including any live-in partner or household member) of any of the following may not enter:

 

  • Fabricsmart Ltd t/a Scrummi and the UK Spa Association ;
  • Any company involved in the organisation, management, promotion, or administration of the competition or its entry routes or donation of prizes or their agents or subsidiaries;
  • Any company involved in any capacity in the sponsorship of a competition or competition prize.

 

 

  1. The opening and closing dates and times for entries are 25th June 00:00am to 8th July 23:59pm Any entries received before the opening and after the closing of the competition will be invalid and will not be entered into the competition.
  2. By entering the competition entrants warrant that all information submitted by them is true, current, and complete.
  3. Entries are limited to one per user by completing the UKSA survey and securing your networking event ticket. Max one entry in total. Entries received that exceed this limit will be invalid and will not be entered into the competition. Anyone trying to circumvent this rule by using alternative details including but not limited to creating multiple accounts will be disqualified from this promotion.
  4. Internet access is required to enter. No purchase necessary. Entry to the prize draw may only be made once the entree has completed the UKSA survey and secured your networking event ticket
  5. The entrant entering the promotion must match the details provided on entry. Proof of ownership and proof of age may be required.
  6. Entrants who make an entry on someone else’s behalf will be disqualified, at the Promoter’s discretion.
  7. Entries (bulk or otherwise) made from trade, syndicates, consumer groups or third parties will not be accepted.
  8. Any entries which are incomplete, incomprehensible, or not received by Fabricsmart Ltd t/a Scrummi and the UK Spa Association will be void. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.

Prize

  1. One of 6 luxurious 30-minute spa treatments. No cash or other alternative prize will be provided in whole or in part, except that in the event of circumstances outside of its control the Promoter reserves the right to substitute a similar prize of equal or greater value. The prize is non-transferable.
  2. The process for determining the winner of the prize is randomly selected from all correct and valid entries, the draw for the winner will take place within 5 days of the date on which the competition closes.
  3. One prize will be given out, within 28 days after the official competition closing date, unless otherwise stated.
  4. Fabricsmart Ltd t/a Scrummi and the UK Spa Association will attempt to notify the winner within 5 days after the closing date. He/she will be contacted by Fabricsmart Ltd t/a Scrummi and the UK Spa Association via the contact details they used to enter the competition. The winner will have a specified fixed time period in which to claim his or her prize of 72 hours from first contact by replying with acceptance of the prize their name and address for delivery. If Fabricsmart Ltd t/a Scrummi and the UK Spa Association is unable to notify the winner, or if the winner fails to respond within the fixed time period as specified, rejects the prize, are ineligible and/or provide an address for delivery of the prize, this may result in forfeiture of the prize and Fabricsmart Ltd t/a Scrummi and the UK Spa Association reserves with these terms and conditions and the competition information the right to select an alternative winner in accordance. The process will repeat until an eligible winner is able to claim the prize. Entrants are encouraged to monitor their connections during this time in case they are the winner.
  5. The prize will need to be booked directly through Fabricsmart Ltd t/a Scrummi and the UK Spa Association 30 days in advance of treatment and be used within 3 months of the competition closing.
  6. The Promoter reserves the right to verify all entries including but not limited to asking for proof of address and ID (passport, driving licence or equivalent). Fabricsmart Ltd t/a Scrummi and the UK Spa Association may in its sole discretion refuse to provide the prize, or seek its recovery, in the event of non-entitlement under these terms or an entrant’s breach of these terms, Fabricsmart Ltd t/a Scrummi and the UK Spa Association website terms of use, fraud, dishonesty, or other inappropriate or improper conduct including but not limited to the use of technology which enables an entrant to evade charges or entry requirements.
  7. Any entrant who enters or attempts to enter the competition in a manner, which in Fabricsmart Ltd t/a Scrummi and the UK Spa Association determination is contrary to these terms and conditions or by its nature is unfair to other entrants may be removed from the competition at Fabricsmart Ltd t/a Scrummi and the UK Spa Association sole discretion.
  8. It is the responsibility of the entrant to provide correct, up-to-date details when entering the promotion and on acceptance of the prize. The Promoter cannot be held responsible for the winner failing to supply accurate information which affects prize acceptance or delivery of their prize.
  9. If fulfilment or any element of this promotion is delayed or affected due to the continuing Covid-19 pandemic and resulting Government restrictions, any affected entrants will be contacted by the Promoter and kept updated of any unavoidable changes to the promotion or prize.

Data Protection and Publicity

  1. Fabricsmart Ltd t/a Scrummi and the UK Spa Association (or any third party nominated by Fabricsmart Ltd t/a Scrummi and the UK Spa Association ) may request to use the winner’s name and their comments relating to the prize and competition experience for future promotional, marketing and publicity purposes in any media worldwide without notice or without any fee being paid.
  2. Information, data (“personal data”) which is provided by entrants when they enter will be held and used by Fabricsmart Ltd t/a Scrummi and the UK Spa Association and their suppliers and contractors solely in order to administer the competition.
  3. All obtained data will be deleted three months after the end date.
  4. By submitting their personal details, the entrant agrees to Fabricsmart Ltd t/a Scrummi and the UK Spa Association processing those details in accordance with the purposes made known the entrant at the time of collection and in accordance with Fabricsmart Ltd t/a Scrummi and the UK Spa Association  Limited privacy policy which can be viewed at https://scrummi.com/pages/privacy-policy
  5. Any entrant who is entering the competition via e-mail may opt out of receiving any further marketing communications from Fabricsmart Ltd t/a Scrummi and the UK Spa Association by using the unsubscribe option on all email marketing communications or can contact Fabricsmart Ltd t/a Scrummi and the UK Spa Association  directly
  6. Fabricsmart Ltd t/a Scrummi and the UK Spa Association shall comply with all applicable requirements of current Data Protection legislation. You can request access to your personal data, or have any inaccuracies rectified, by sending an email to marketing@scrummi.com. By participating in the promotion, you agree to the use of your personal data as described here.

Liability

  1. Fabricsmart Ltd t/a Scrummi and the UK Spa Association cannot promise that the services relating to the competition will be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. These services may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons reasonably beyond the control of Fabricsmart Ltd t/a Scrummi and the UK Spa Association.
  2. Fabricsmart Ltd t/a Scrummi and the UK Spa Association will not be liable in the event that all or any part of the service relating to the competition is discontinued, modified or changed in any way.
  3. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion, the fulfilment of the prize and/ or the use of the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.

Standard terms

  1. If for any reason any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, traffic congestion, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion modify or suspend the promotion or invalidate any affected entries. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.
  2. The Promoter will make available the winner’s surname and county of residence to members of the public or regulators who request such details within 3 months of the closing date of this promotion. Entrants can object to disclosure, or request that disclosure be limited in scope by contacting marketing@scrummi.com. We may nevertheless disclose the information to the Advertising Standards Authority if required to do so. You may request a copy of the winner’s list by emailing marketing@scrummi.com.
  3. In the event that any entrant does not, or is unable to, comply with and meet these terms and conditions and the competition information, Fabricsmart Ltd t/a Scrummi and the UK Spa Association shall be entitled at its sole discretion to disqualify such entrant, without any further liability to such entrant. In these circumstances, the prize won by the entrant may be forfeited and Fabricsmart Ltd t/a Scrummi and the UK Spa Association  reserves the right to reclaim the prize already distributed to the entrant. Any entrant must comply with any directions given to him or her by Fabricsmart Ltd t/a Scrummi and the UK Spa Association  including but not limited to any and all relevant laws, rules and applicable regulatory codes.
  4. The invalidity or unenforceability of any provision of these Terms and Conditions shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Terms and Conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
  5. The Promoter’s decision is final with regard to all promotional matters and no correspondence will be entered into.
  6. Any question concerning the legal interpretation of the rules will be based on English law and the Courts of England and Wales will have exclusive jurisdiction unless you live in another part of the UK, in which case your local courts will have jurisdiction.
